If it is a domestic (pet) duck, take it to a veterinarian. If it is a wild duck, contact a licensed wildlife rehabilitator. You can find one here: http://www.tc.umn.edu/~devo0028/contact....
These people have the specialized training to care for sick, injured and orphaned wild animals. They also have the state and federal licenses required in order to keep wild animals, even for a short time, until they are healthy enough to be released.
I don't know why you assume it needs to be killed just because it is injured. Many injured animals can be treated, and recover nicely. If it is injured too badly to attempt treatment, the vet or the rehabber will see to it that it is humanely put down. You are correct, killing it yourself would be illegal. If it is a pet, it would be animal cruelty. If it is a wild duck, it is protected by the Migratory Bird Treaty Act. Let the professionals take care of it.
